Anaconda Repository

ANACONDA, INC. (“Anaconda”) maintains a code repository for use by its user community. These Terms of Service (“Agreement”) relate to your use of the compilation of products and tools, made available by Anaconda through https://repo.anaconda.com/ and through our installers and applications (the “Repository”) and serve to make it possible for Anaconda to continue to provide the Repository. So that our community can have this resource, we ask that everyone who uses the Repository respects the other users and complies with the terms of this Agreement. By using the Repository or otherwise agreeing to this Agreement, you represent and warrant to Anaconda that you are legally competent to become a party to this Agreement. IF YOU HAVE NOT AGREED TO THIS AGREEMENT OR IF YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT, THEN YOU MUST NOT USE THE REPOSITORY. License to Use Repository

LICENSE TO USE REPOSITORY

Anaconda wants to be a resource to the community of developers working in data science and modern machine learning! We have created our Repository to enable our community to create so permission is hereby granted to utilize the Repository subject to the terms of this Agreement. So that we can be sure the Repository works as a resource for our community of developers, we are not granting you permission to use the Repository for commercial activities (as defined below) or in a way that could negatively impact other users, such as downloading or mirroring the entire Repository. We reserve the right to reduce bandwidth availability to users who take advantage of the resource we are providing through the Repository so we can maintain the overall experience for the other community members at large. For users that want to engage in commercial activities or uses that place a heavier burden on our system, we encourage you to contact us to learn more about our commercial offerings. You must also agree that you will not under any circumstances violate our Acceptable Use Policy (the “Policy”) found at anaconda.com/acceptable-use-policy. The license we are providing shall automatically terminate if you violate the Policy, or this Agreement, or use the Repository in a way that negatively impacts the other members of our community. Your use of the Repository is at the sole discretion of Anaconda, which may deny you further use of the Repository or terminate this license at any time, for any reason, with or without cause. Your use of the Repository does not entitle you to continued use of the Repository. This Agreement does not serve to modify or change the terms applicable to any tool or package included in the Repository, each of which are subject to their own license which provides the terms under which you can use, store and redistribute such package or tool, including any applicable open source license (see more information below under the heading “Packages and Tools in the Repository”). This Agreement relates to Anaconda’s proprietary compilation that provides enhanced access, metadata curation and repodata to you.
Your use of the Repository must always comply with applicable laws, including copyright or trademark laws, export control or sanctions laws, or other laws in your jurisdictions, and the terms of this Agreement. In particular, but without limitation, you agree not to use the Repository to:

  • mirror the Repository or create a cache via any automated means including as prohibited below under the heading “Access and Interference”;
  • engage in commercial activities to market the Repository or a material portion of its contents or engaging in activities which encourage the use of the Repository in a manner that violates this Agreement, or utilizing the Repository in a way that could degrade the ability of our other community members to use the Repository;
  • republish any material portion of the Repository in a manner competitive with the offering by Anaconda, including republication on another website or creating a public or private mirror without express permission from Anaconda (For private mirrors, we encourage you to contact Anaconda at [email protected] for more information about Anaconda Enterprise);
  • sell, rent or sub-license material from the Repository; or
  • redistribute or embed any or all Anaconda tools with the explicit exception of Miniconda installer in a commercial product for redistribution or resale.

Anaconda reserves the right to discontinue or alter any or all of the Repository. To avoid confusion, “commercial activities” are any use of the Repository which is NOT:

  • use solely by an individual using for personal, non-business purposes,
  • use by a student or employee of an educational institution in connection with educational activities,
  • use by an employee or volunteer on behalf of a non-profit institution in connection with the provision of charitable services,
  • use by a 501(c)(3) non-profit research institution in connection with non-commercial activities, such as research to address societal needs and global challenges, public policy development, or the advancement of science for the general good, where such work will not result in revenue to the institution, or use by entities in common control with each other with fewer than 200 employees in aggregate.

The downloading of Anaconda® Distribution installer and the Miniconda® installer (and their bundled packages) shall not be considered a commercial activity.

THIS CUSTOMER AGREEMENT (“AGREEMENT”) SETS FORTH THE TERMS AND CONDITIONS ON WHICH ANACONDA, INC. (“ANACONDA”) IS WILLING TO MAKE AVAILABLE “anaconda.org”, ANACONDA’S CLOUD HOSTED PACKAGE MANAGEMENT SERVER (THE “SERVICE”), TO YOU, THE CUSTOMER (“CUSTOMER” OR “YOU”). BY PROCEEDING TO ACCESS AND USE THE SERVICE, YOU ARE AGREEING TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, WHICH IS A LEGALLY BINDING AGREEMENT. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE ACCEPTING IT AND USING THE SERVICE. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU SHOULD REJECT IT AS INDICATED BELOW, IN WHICH CASE YOU WILL NOT BE PERMITTED TO ACCESS THE SERVICE.s.

  1. License Grant. Subject to the terms and conditions of this Agreement, and in consideration of the use restrictions and obligations herein as well as payment of any applicable fees, Anaconda hereby grants to Customer a nonexclusive, nontransferable, revocable right and license for Customer to access and use the Service in accordance with the rules and restrictions of Customer’s subscription plan (the “License”). The License is restricted to use by Customer and does not include the right to use Anaconda Technology (as defined below) on behalf of any third-party. All rights not expressly granted to Customer herein are reserved by Anaconda and its licensors. There are no implied rights.
  2. Anaconda Technology. Anaconda shall operate and support the Service, including the Anaconda Technology (as defined below), the server hardware, disk storage, firewall protection, server-operating systems, management programs, web-server programs, documentation, and all other information developed or provided by Anaconda or its suppliers under this Agreement. For purposes of this Agreement, “Anaconda Technology” means all of Anaconda’s proprietary technology (including without limitation, software, hardware, products, processes, algorithms, user interfaces, know-how, techniques, designs, and other tangible or intangible technical material or information) made available to Customer by Anaconda in providing the Service. Customer acknowledges and agrees that: (i) as between Anaconda and Customer, all right, title, and interest in and to the Anaconda Technology, the Service, and all derivatives thereof (including without limitation any and all patents, copyrights, trade-secret rights, trademarks, trade names, and other proprietary rights embodied therein or associated therewith) are and shall remain Anaconda’s or its licensors’ and this Agreement in no way conveys any right or interest in the Anaconda Technology or the Service other than the License, and (ii) the Anaconda Technology and the Service are works protected by copyright, trade secret, and other proprietary rights and laws. The Anaconda name, the Anaconda logo, and the Service names associated with the Service are trademarks of Anaconda or third parties, and no right or license is granted to use them. Customer shall not remove any Anaconda trademark or logo from the Service.
